 Jesha Miller freedom was taken in violation of the 13th & 14th amendment which abolished slavery. This is prohibition according to the rule of law.  The first section of the Amendment declares: “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.” The Amendment is unique in the Constitution because it bars every person from holding slaves or engaging in other forms of involuntary servitude, whereas most constitutional provisions only constrain or regulate the government.

The First Amendment: Basic Liberties. The First Amendment is perhaps the most important part of the Bill of Rights. It protects five of the most basic liberties. The government exists for specific reasons and has certain powers that enable it to function and achieve its goals. However, the nature of its power is that it has to be contained, or else it will naturally want to expand. If a government becomes too strong it can lead to all sorts of problems and abuses. Government should therefore have no more power than what is necessary to carry out its duties, and the structure of government has to safeguard us from unwarranted acquisition of power.

The principle of separation of powers

It is almost universally accepted now that a democratic government needs to have separation of powers, which means that the government has to be divided into branches, each with separate and independent powers and areas of responsibility. The common division of branches is into a legislature, an executive, and a judiciary. A system of checks and balances that governs interactions between them ensures that no branch of government can become too powerful: they limit each other, at least in principle.

Of course, any government can become corrupt. Constitutional safeguards can fail, in which case the division of power into branches becomes a dead letter on paper. Therefore it is crucial that we don’t put all of our eggs in one basket. The second major principle of balanced governance that we should employ is subsidiarity – an organizing principle of decentralization. Judge David Kiely has instructions order that there be a cross section in the venire,  for a fair & impartial jury required by the 14th amendment & Federal legislation of which he knowingly refused.                                Appeal to the US SUPREME Court / Case No. 04-7377.

 The appeal went to the US SUPREME COURT using the Habeas corpus for a citizen held in violation of the Constitution & Laws of the U.S. The Court committed an abuse of power by denying the right to a Habeas corpus which is a power denied government under Article I,  sec. 9 of the Constitution. Dereliction of duty as every Federal Judge when addressed by Habeas corpus has a duty to check the records & if true must immediately RELEASE the citizen from the unconstitutional imposed slavery immediately.                                          Treasury owes 145 million dollars

   The treasury owes a total of 145 million dollars owed for default which I  have proven by the transcripts impossible to deny officials denied the unalienable right all men are created equal. This would have been 50 million dollars initially but by government constant refusing to pay there is 10 percent interest on every year's refusal dating back to 1998. 10 percent of 50 million dollars is 5 million dollars yearly totaling to 145 million dollars owed.  This is the same as when government charges interest for taxes being paid late. Government collected a trillion dollars in the past 4 months & have refused to pay the money owed for default of due process & miscarriage of Justice imposing slavery. Restitution MUST be made immediately & no later than this Friday,  March 3, 2017 to stop any further oppression.

                                        Criminal offenses under Title 18

Title 18 sec. 243 which is the exclusion of jurors on account of race which is a federal crime with two prongs;  one violating the 14th amendment & two Congress made it a crime to deter judges from excluding Black people from the jury pool. This renders black people to second class citizenship & violates the equal protection  clause.

The 14th amendment mandate that race discrimination be eliminated from all official acts and proceedings of the State is most compelling in the judicial system. The statutory prohibition on discrimination in the selection of jurors, 18 U.S.C sec. 243, enacted pursuant to the 14th amendment states enabling clause makes race neutrality in jury selection a visible and inevitable measure of the judicial system own commitment to the demands of the Constitution. ( As demonstrated both the State & Federal Court have refused to adhere to the demands of the Constitution & must be held accountable for their actions. ) The Constitution requires they be checked for corruption.

The courts are under an affirmative duty to enforce the strong statutory & Constitutional policies embodied in that PROHIBITION.  

Constitutional Law 250.2 (4) - provides every Black man has a right under the 14th amendment to the Constitution U.S.C.A. , that in the selection of jurors to pass on his life, liberty, or property, there shall be no exclusion of his race and no discrimination against them because of their color.

Mr. VOWELS : My client objects to the FACT that none of the venire men nor the jury are Black people.  He - - -and that is based on an assertion that he is entitled to a jury of his peers. The component of race should be included in the concept of peers. The Fact that there are no black people within this venire I think causes this jury not to be a jury of my clients peers. ( This affirms not only have the Judicial branch violated all three charters of freedom but also the laws of the Constitution. )

   Wherefore,  Jesha Miller having demonstrated the Judicial system denied the unalienable right all men are created equal which is guaranteed by the Bill of Rights that government must protect,  you Steven Mnuchin are obligated to pay Jesha Miller 145 million dollars owed for default of due process & a miscarriage of Justice imposing slavery no later than this March 3, 2017 which is 5 days away so this is a timely manner as government is waiting for me to die.
